Hampton City, Virginia State Court Records

In Hampton City, court records are verbatim accounts of judicial proceedings heard in the city’s trial-level courts. These records, permanently maintained by the clerks of court in accordance with the relevant rules or laws, are crucial to judicial accountability and transparency. They are also useful for legal research, historical context, background checks, and appellate review.

Hampton City court records, while primarily documenting legal proceedings, can incorporate other documents maintained by other agencies. For instance, vital records (birth, death, marriage, and divorce certificates) may be included in court records if filed to assert or request a legal right. Similarly, property records may be found within court files when submitted as evidence in lawsuits concerning real estate disputes (e.g., boundary disagreements) or other civil actions.

Are Hampton City Court Records Public?

Yes. Titles 16.1 and 17.1, Virginia Code, grant members of the public extensive access to the records of the judiciary, except where an exemption is imposed by law, court rule, or court order. Consequently, anyone can examine or duplicate Hampton City court records; no proof of identity or relationship to the record subject is required. The following are considered confidential court records:

  • Child support and spousal support case files (§ 16.1-305.01)
  • Mental health commitment records
  • Adoption records
  • Sealed or expunged records
  • Juvenile records
  • Personal Identifying Information (PII), such as financial account numbers and Social Security numbers

What Information is Available in Hampton City Court Records?

Court records include both case information and case documents. Case information offers key details such as the names of the litigants, their attorneys, the assigned judge or magistrate, the case number, case type, current status, filing date, hearing schedule (dates and locations), and the final disposition. Case documents, on the other hand, are the actual filings within the case. These encompass documents generated by the court or submitted by the parties, including indices, dockets, pleadings, summonses, warrants, affidavits, motions, orders, and judgments. Criminal Records Access in Hampton City

The term "criminal records" does not refer to one set of records maintained by a single government institution. Put simply, these records encompass records maintained by criminal justice agencies regarding the arrest, prosecution, conviction, sentencing, and release of a person alleged to have violated a state law or local ordinance. The most comprehensive catalog is maintained by the Central Criminal Records Exchange (CCRE), which is a division of the Virginia Department of State Police.

To access records from the Virginia State Police (referred to as criminal history record information), individuals can use the necessary forms and procedures on the agency’s Virginia Criminal History Records Check page. Importantly, dissemination of VSP records is strictly controlled by Va. Code Ann. § 19.2-389. The law limits access to persons or entities who possess the subject of the record’s notarized signature or are otherwise permitted by law and pay the assessed fees. Juvenile records, however, are not dispensed unless to authorized entities, as specified in Va. Code Ann. § 19.2-389.1.

Members of the public who wish to inspect criminal records in Hampton, however, have access through the court system, where records of criminal prosecutions are maintained. Criminal court records can be obtained as explained in the "Hampton City Court Records Search" section.

Hampton City Probate Records

Probate is a court proceeding initiated after a person’s death to validate their will, appoint personal representatives, and distribute their assets accordingly. The probate court in Hampton is the Hampton City Circuit Court (Va. Code Ann. § 64.2-443). This court oversees the administration of decedents’ estates and trusts, as well as protective proceedings that involve the establishment of guardians (for personal care) or conservators (for financial/property management) for incapacitated adults or minors (§ 64.2-2001).

Probate or estate records can be accessed in person at the Hampton circuit courthouse, by formal request to the circuit clerk’s office, or online through the free Circuit Court Case Information system. Titles 16.1 and 17.1 of the Virginia Code permit this public access, but records deemed confidential, such as bank account numbers, are only released to legally authorized parties, such as the case parties.

Hampton City Family Court Records

Family court records document proceedings related to family or domestic issues. In Hampton, two courts heard these cases: the circuit court and the J&DR court. The circuit court has original jurisdiction over adoptions, divorces, annulments, legal separations, and equitable distribution. Meanwhile, the juvenile and domestic relations court has shared jurisdiction with the circuit court in matters of child custody, visitation, and support.

While circuit court records are generally public unless sealed by a judge or restricted by law, J&DR records are confidential under Va. Code Ann. § 16.1-305 and are only open to statutorily specified parties, such as the judge, the attorney for any party, or the case parties.

Access to court records can be achieved in person at the clerk’s office (same as the courthouse) or by contacting the clerk for access procedures. For circuit court records, individuals can also search the online Circuit Court Case Information system.
